CloudSignage Hardware Limited Warranty

1. Overview

This CloudSignage Player Limited Warranty (“Limited Warranty”) is provided by Landing Media Inc. / CloudSignage (“Company”) and applies to the CloudSignage Player and any branded hardware supplied by Company (the “Device”).

2. Limited Warranty

Company warrants that the Device will be free from material defects in materials and workmanship for a period of twelve (12) months from the ship date to the original purchaser (the “Warranty Period”). This Limited Warranty is valid only in Canada and the United States, unless otherwise specified in writing.

Customer’s sole remedy and Company’s sole liability for a breach of this Limited Warranty is, at Company’s option, to repair or replace the Device with a new or factory recertified Device. No more than three (3) replacements of the Device are allowed under this Limited Warranty.

Customer must notify Company of any alleged breach of this Limited Warranty within five (5) days after the expiration of the Warranty Period. Company may require that materially defective Devices be returned to Company or an authorized service location for inspection and warranty replacement.

3. Exclusions

This Limited Warranty does not apply if the Device:

  • is used with displays, power supplies, or other products that are not compatible with the Device or do not meet Company’s specifications;
  • is plugged directly into a wall outlet without appropriate surge protection or power conditioning;
  • is used for any unapproved purpose or in violation of applicable laws, including but not limited to displaying unlawful or infringing content;
  • is modified, opened, or tampered with by anyone other than Company or its authorized service providers;
  • is loaded with, or configured with, anything other than the native firmware or software provided or approved by Company;
  • is damaged by acts of God, power surges, misuse, abuse, negligence, accident, wear and tear, unreasonable use, or by causes unrelated to defective materials or workmanship;
  • has had the serial number or any identification label altered, defaced, or removed; or
  • was purchased from an entity other than Company or an authorized reseller of Company products.

This Limited Warranty covers only the Device itself. It does not cover any software or cloud services (which are provided under separate terms and conditions), any third party hardware or displays used with the Device, or damage to any other equipment or property.

4. Disclaimer of Other Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, COMPANY DISCLAIMS ALL OTHER WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTIES OF MERCHANTABILITY, TITLE, AND FITNESS FOR A PARTICULAR PURPOSE, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.

SOME PROVINCES OR STATES DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU. WHERE IMPLIED WARRANTIES CANNOT BE EXCLUDED, SUCH WARRANTIES ARE LIMITED IN DURATION TO THE WARRANTY PERIOD SET OUT ABOVE.

5. How to Exercise This Limited Warranty

5.1 If Purchased from Company

If you purchased the Device directly from Company, you must contact Company support to troubleshoot and verify warranty eligibility using a method described at https://cloudsignage.net/support or another support URL provided by Company.

After verifying eligibility, Company will, at its option, ship a replacement Device to Customer and provide instructions for the return of the defective Device. Company reserves the right to invoice Customer for the replacement Device and associated freight, shipping, and handling costs if the defective Device is not returned within the time specified by Company.

5.2 If Purchased from an Authorized Reseller

If you purchased the Device from an authorized reseller, you must contact the authorized reseller to verify eligibility and obtain instructions for exercising the warranty. The reseller may handle returns and replacements directly or coordinate with Company, depending on the reseller agreement.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, COMPANY WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING, WITHOUT LIMITATION, LOSS OF PROFITS, REVENUE, OR DATA, ARISING OUT OF OR RELATED TO THE DEVICE OR THIS LIMITED WARRANTY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT WILL COMPANY’S TOTAL LIABILITY UNDER THIS LIMITED WARRANTY EXCEED THE ORIGINAL PURCHASE PRICE PAID FOR THE DEVICE.

7. Governing Law

This Limited Warranty is governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of laws principles. Any dispute arising out of or relating to this Limited Warranty will be subject to the exclusive jurisdiction of the courts located in Vancouver, British Columbia, Canada.

8. Your Rights

This Limited Warranty gives you specific legal rights. You may also have other rights which vary by province, state, or country. Nothing in this Limited Warranty is intended to limit any rights you may have under applicable consumer protection laws in British Columbia, Canada, or other jurisdictions where such laws apply.
